Terms & Conditions

These Terms & Conditions ("Terms") govern access to and use of the neekOS Remote remote-desktop service, including the admin console, user console, host wiring portal, and the host software (together, the "Service"), provided by eVamb Technologies Inc. ("eVamb", "we", "us"). By ticking the acceptance box, signing in, or installing or running the host software, you ("you", the "User", or the "Host Operator") agree to these Terms. If you do not agree, do not use the Service.

1. The Service

neekOS Remote lets an administrator enrol host machines and grant named users remote access to specific devices. Screen video is carried over WebRTC (DTLS-SRTP); control input is additionally sealed with a key derived from the host password that the signaling relay never receives. The relay performs signaling and access-policy enforcement only and does not receive session content.

2. Accounts, Roles & Access

• Access is provisioned by an administrator. Signing in — including with a third-party identity provider such as Google — authenticates who you are; it does not by itself grant access. An administrator must provision your email, role, and permitted devices.
• You are responsible for keeping your credentials, host passwords, and device access confidential, and for all activity under your account.
• The administrator (owner/admin) is responsible for who they grant access to and which devices they expose, and represents that they are authorised to do so.

3. Authorised Use Only

• You may access only devices you have been explicitly authorised to access, and only for lawful, authorised purposes.
• You must not use the Service to gain unauthorised access to any system, to surveil or record any person without a lawful basis and any consent required by applicable law, or in any way that violates the rights of others.
• The Host Operator represents that they own the host machine or are authorised to install remote-access software on it, and that they have obtained any consent or given any notice required by law or workplace policy for its users.

4. Acceptable Use

You must not: (a) use the Service unlawfully or to facilitate unlawful activity; (b) attempt to circumvent access controls, authentication, encryption, or rate limits; (c) introduce malware or interfere with the integrity or performance of the Service; (d) reverse engineer, resell, or sublicense the Service except as permitted by law; or (e) use the Service to infringe intellectual-property or privacy rights.

5. Security & Encryption

The Service applies end-to-end encryption to control input and transport encryption (DTLS-SRTP) to video. The self-hosted relay never receives session decryption keys. Nevertheless, no method of transmission or storage is completely secure. You are responsible for the security of your own relay deployment, host machines, endpoints, and credentials. The Service is provided without any guarantee that it is free of vulnerabilities.

6. Data & Privacy

• Session content (screen video and control input) is end-to-end / peer-to-peer and is not accessible to the relay operator in usable form.
• The Service processes account and operational data such as email, display name, role, device identifiers, machine names reported by hosts, connection metadata, and audit-log events, in order to operate the Service and enforce access.
• Where you deploy and operate the relay and hosting yourself, you are the controller of the personal data processed in your tenant and are responsible for your own privacy notices and lawful basis. Third-party infrastructure (e.g. Google Firebase Hosting, and Google Sign-In where enabled) is subject to the respective provider's terms and privacy policy.

7. Availability

The Service — including the relay you operate — is provided on an "as available" basis with no uptime commitment unless separately agreed in writing. Maintenance, network conditions, or your own infrastructure may cause interruptions.

8. Intellectual Property

The Service and all related software, designs, and marks are the proprietary property of eVamb Technologies Inc. and its licensors. No rights are granted except the limited right to use the Service in accordance with these Terms.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTY THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EVAMB WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO THE SERVICE. Nothing limits liability that cannot be limited under applicable law.

11. Indemnification

You agree to indemnify and hold harmless eVamb from claims arising out of your use of the Service in breach of these Terms or applicable law, including unauthorised access to any device or data.

12. Termination

An administrator may revoke your access at any time. We may suspend or terminate access for breach of these Terms or applicable law. Provisions that by their nature should survive termination will survive.

13. Changes to These Terms

We may update these Terms. Material changes will be reflected by a new version number and effective date, and continued use after changes take effect constitutes acceptance.

14. Governing Law

These Terms are governed by the laws of the jurisdiction specified by eVamb Technologies Inc. in the applicable order or, absent that, the jurisdiction of eVamb's incorporation, without regard to conflict-of-laws rules. [Insert governing law and venue.]
